What New York law actually says

New York does allow hemp drinks. It allows them at a dose almost nobody makes. Under the state’s cannabinoid hemp rules, Part 114, an orally consumed hemp product cannot exceed 10mg of total THC per package or 1mg per serving, and it has to carry a ratio of at least 15 parts CBD to 1 part THC. Beverages get one more rule stacked on top: they must be packaged so that there is no more than a single serving per package.

Put those together and a lawful New York hemp drink is a 1mg can sitting next to 15mg or more of CBD. The 5mg and 10mg seltzers that make up essentially the entire category are five to ten times over that line, and shopping around does not change it. They are not being sold here through a loophole; they are simply not legal to sell to a New Yorker.

Where the real THC drinks in New York are

This is the part that gets missed. New York has proper THC drinks and they are not hard to find. They are in the licensed adult-use dispensaries, sold under the state’s marijuana rules rather than its hemp rules, where the cap is 10mg of THC per serving and 100mg per package. So the honest answer to “can I drink a 10mg THC beverage in New York” is yes, easily, as long as you buy it from a dispensary rather than a website. Will anyone ship THC drinks to New York?

Officially no, not at a normal dose. A 5mg drink cannot lawfully be sold to a New York address whether it arrives by truck or by mail, and the state has been active about enforcement: the Office of Cannabis Management has run well over a thousand inspections of unlicensed sellers and seized tens of millions of dollars in product.

The federal hemp redefinition caps hemp products at 0.4mg of total THC per container, and the date moved on September 3, 2026 when the president signed the funding bill carrying the delay. For drinks it now lands December 11, 2026 rather than November 12. That ends the hemp mail-order era nationally, including the brands currently shipping into New York against state rules. The delay is not blanket: delta-8, delta-10 and other cannabinoids the plant cannot produce on its own still lose hemp status on November 12, 2026.

New York is better placed for what comes next than most states. Dispensary drinks are sold under state marijuana law, not hemp law, so December 11 does not touch them. Are THC drinks legal in New York?
